Background Check Appeals

Individuals denied employment under qualifying provisions may submit a formal appeal for independent review by the Office of Oversight and Compliance.

Who May Appeal

Any individual who has been formally denied employment by a qualifying department or agency on the basis of a background check may submit an appeal to the Office of Oversight & Compliance. Appeals are reviewed independently of the denying agency.

Accepted Grounds for Appeal

Factual Inaccuracy

The information used in the background check was incorrect, outdated, or did not apply to you.

Procedural Error

The background check process was not conducted in accordance with established standards or policies.

Mitigating Circumstances

There are relevant facts or context that were not considered during the original review.

Changed Circumstances

Circumstances that formed the basis of the denial have materially changed since the original decision.

Step 02

OOC Review

The Office of Oversight & Compliance independently reviews your appeal against the denying agency's records.

Step 03

Decision Issued

A decision is issued. If approved, the OOC may direct the agency to reconsider or overturn the denial.
