Security Clearances

Eligible personnel from partner agencies may apply for a State security clearance to access classified information and OSI systems. Clearances are governed by 4 M.S.C. 3 § 1201.

Classification Levels

4 M.S.C. 3 § 1201(d)

'O' Classification

'O' Classification shall be applied to information of the highest sensitivity, accessible only to the Governor, the State Intelligence Director, and individuals explicitly cleared by both.

Criteria

Requires dual authorization from the Governor and the State Intelligence Director.

Access

Restricted to the Governor, Director of State Intelligence, and explicitly cleared individuals.

4 M.S.C. 3 § 1201(a)

Top Secret

"Top Secret" shall be applied to information, the unauthorized disclosure of which reasonably could be expected to cause exceptionally grave damage to the state security or impede ongoing criminal investigations or judicial processes that the original classification authority is able to identify or describe.

Criteria

Unauthorized disclosure would cause exceptionally grave damage to state security or ongoing proceedings.

Access

Granted to senior personnel in authorized intelligence and law enforcement roles.

4 M.S.C. 3 § 1201(b)

Secret

"Secret" shall be applied to information, the unauthorized disclosure of which reasonably could be expected to cause serious damage to the state security or impede ongoing criminal investigations or judicial processes.

Criteria

Unauthorized disclosure would cause serious damage to state security or ongoing proceedings.

Access

Granted to authorized agency personnel with a demonstrated operational need.

4 M.S.C. 3 § 1201(c)

Confidential

"Confidential" shall be applied to information, the unauthorized disclosure of which reasonably could be expected to cause damage to the state security or impede ongoing criminal investigations or judicial processes.

Criteria

Unauthorized disclosure would cause damage to state security or ongoing proceedings.

Access

Entry-level clearance for authorized partner agency personnel.

Note: All clearance levels are governed by the Mayflower State Code, 4 M.S.C. 3 § 1201. Clearance eligibility and assignment are determined solely by the Office of State Intelligence. Submission of an MSF-24 application does not guarantee clearance approval. Unauthorized disclosure of classified information is a criminal offense under 4 M.S.C. 3 § 1601 and § 1602.
